THSE Recorder · last updated [DATE]

DRAFT — to be reviewed by a lawyer before publication (Ecuador first; then the US, the EU and each Asian market). Replace the [BRACKETED] parts. Checklist: docs/LEGAL.md.

1. Who we are

THSE Recorder is provided by Ariel Samir Rivera Murillo, doing business as Nostricorp, based in Ecuador ("we", "us"). Contact: [SUPPORT E-MAIL]. Misuse reports: [ABUSE E-MAIL]. Privacy requests: [PRIVACY E-MAIL].

2. The service

THSE Recorder is software that runs in your web browser to create documentary records of your videos and export them with a HUD. Your footage, records and exported videos are processed and stored on your own devices or in folders you choose; we do not receive, review or host them. Online, we only handle your account and your subscription (see the Privacy notice).

3. Accounts and age

Some plans require an account. You must be at least 16 years old (or the age of digital consent in your country, if higher) or have permission from a parent or guardian, who then accepts these terms. Keep your password private; you are responsible for activity under your account. Give accurate account information.

4. Plans, billing and renewal

5. Withdrawal and refunds

6. Your content and the details you declare

7. Acceptable use

You agree not to use THSE Recorder to:

8. Misuse reports

Anyone may report a misuse to [ABUSE E-MAIL]. We review each report; if an account is used against these terms we may warn, suspend or close it (and its subscription), and we cooperate with competent authorities when the law requires it. Since we do not hold your content, we act on accounts, not on files on your devices.

9. License and intellectual property

THSE Recorder, its design, HUD, Looks, brand and documentation belong to us. While your plan is active we grant you a personal, non-exclusive, non-transferable license to use it on the number of devices your plan includes. The Free plan is licensed on the same terms with its limits. Third-party components keep their own licenses (for example Mediabunny, MPL-2.0); see the credits.

10. Availability, changes and the end of the service

We may update, improve or change features. If we ever stop offering THSE Recorder, we will tell you in advance [90 days]; your records, videos and library folder remain yours as plain files you can keep using and backing up.

11. When a subscription ends

Your work is never deleted or locked for viewing. What you created with a paid plan stays visible, playable and exportable, and you can back it up; it cannot be edited or generated again until you renew. New work follows the Free plan.

12. No warranty

THSE Recorder is provided "as is" and "as available". We work to keep it reliable, but, to the extent the law allows, we do not guarantee it will be error-free, uninterrupted or fit for a particular purpose. Keep backups of your library (BACKUP TO… and EXPORT LIBRARY JSON). Nothing in these terms limits rights you have as a consumer under mandatory law.

13. Liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages or loss of data, nor for the content users create or the details they declare, and our total liability is limited to the amount you paid us in the last 12 months. This does not limit liability that cannot be limited by law (for example for intent or gross negligence).

14. Indemnity

You agree to defend and hold us harmless from claims, damages and costs (including reasonable legal fees) arising from your content, the details you declare or your breach of these terms, to the extent the law allows.

15. Export controls and sanctions

You may not use or buy THSE Recorder where prohibited by applicable export-control or sanctions laws, or if you are a person subject to such sanctions.

16. Changes to these terms

We may update these terms. We will announce important changes in the app or by e-mail at least [30] days before they apply; if you do not agree, you may cancel before then.

17. Law and disputes

These terms are governed by the laws of Ecuador, without removing the mandatory consumer protections of the country where you live. Disputes go to the competent courts of Ecuador, except where your consumer law gives you the right to go to your local courts. EU consumers may also use the EU online dispute resolution platform.

18. General

If a clause is invalid, the rest stays in force. These terms (with the Privacy notice and the plans page) are the whole agreement between us. You may not transfer your account or these terms; we may transfer them to a company that continues the service, keeping your rights. Neither party is responsible for delays caused by events beyond reasonable control. Not enforcing a clause is not a waiver. If these terms are translated, the English version prevails, except where the law requires otherwise.
